<p>That’s right. According to the IRS itself, houses of worship are free to speak to their people about elections and candidates—boldly, biblically, and without fear. They even compared it to “a family discussion concerning candidates.” That’s their phrase—not ours.</p>
<p>The irony? This has long been the IRS’s unspoken policy—but the deception was allowed to stand. Many churches believed the myth of “separation of church and state” meant silence in the pulpit. But that was never true. And now the law agrees. We’ve long said the Church is not the problem—it’s the solution. And now, more than ever, the Church must lead with clarity, courage, and truth.</p>

(Miami, FL) Today, Governor<strong> Ron DeSantis</strong> will announce the appointment of Judge <strong>Robert Luck</strong> to the Florida Supreme Court.  Judge Luck currently sits on the Third District Court of Appeals (DCA) in Miami.  The Third DCA is the appeals court between the trial court and the state supreme court in South Florida.</p>
<p>Judge Luck is being picked for an at-large seat and is the second of three appointments that Governor DeSantis will make to replace three of the most liberal justices who termed out for mandatory retirement at age 70 on Tuesday, January 8, 2019.  Last week DeSantis also appointed Judge <a href="https://www.flfamily.org/news/governor-appoints-barbara-lagoa" target="_blank" rel="noopener" data-saferedirecturl="https://www.flfamily.org/news/governor-appoints-barbara-lagoa">Barbara Lagoa</a> to the Florida Supreme Court.</p>
<p>Florida Family Policy Council President <strong>John Stemberger</strong> issued the following statement today regarding this appointment:</p>
<p>“Robert Luck is a brilliant jurist. To speak with, or listen to Judge Luck, is to realize you are in the presence of a truly unique and Scalia-like intellect.  Luck fully understands that the role of a judge is a limited one of restraint.  He has demonstrated over the years through his written decisions and public statements, that the job of a judge is to interpret law as it is written and not make law or engage in result-oriented decision making.  As an observant Jew, Luck is also grounded in ethical and moral principles that will surely guide and inform his service to the state of Florida.  Once again, Ron DeSantis has made a very solid appointment that will help to define his legacy as Governor for years to come.”</p>
<p>Regarding judicial philosophy Judge Robert Luck has stated the following:</p>
<p>“I understand how the judiciary — what Hamilton called our least dangerous branch — fits into our system of government… Having worked in each of the three branches, I understand the modest role of the judge in reviewing the laws enacted by the legislature, the actions taken by the executive, and the findings of the lower courts… I have conducted myself that way for the last five years, and I will continue to do so as long as I am permitted to serve.”</p>
<p><strong>Personal and Professional Biography of Robert Luck:</strong></p>
<p>Robert Luck currently sits on the Third District Court of Appeals and prior to that served on the Eleventh Judicial Circuit Court of Florida as a trial court judge. His district court nomination was made by Governor Rick Scott.  Born and raised in Miami-Dade County, Judge Luck would go on to graduate magna cum laude from the University of Florida Levin Law school and gain a prestigious clerkship with Chief Judge Edward Carnes of the 11th Circuit in Alabama. Judge Luck also has experience as Deputy Chief in the Major Crimes Section in the United States Attorney’s Office for the Southern District of Florida. As a trial judge he tried seventy jury trials, as an appellate judge he has written over 70 decisions and has heard dozens of appeals from the county court and municipal agencies.  Robert Luck is part of the Miami Jewish Legal Society and currently lives in Miami-Dade County with his wife and two children.  The Luck family attends a Chabad synagogue in Miami.  Chabad is one of the largest observant and orthodox movements within Judaism worldwide.</p>

<p style="text-align: center;">(Tallahassee, FL) Today, as his first very first act in office, Governor <strong>Ron DeSantis</strong> announced the appointment of Judge <strong>Barbara Lagoa</strong>, the first of three appointments which are expected to the Florida Supreme Court.  Judge Lagoa currently sits on the Third District Court of Appeals (DCA) in Miami.  The Third DCA is an appeals court between the trial court and the state supreme court.</p>
<p style="text-align: center;">Florida Family Policy Council President <strong>John Stemberger</strong> issued the following statement today regarding this appointment:</p>
<p style="text-align: center;">“Governor Ron DeSantis has made a simply outstanding choice in Barbara Lagoa for the Florida Supreme Court.  She is smart, thoughtful, and has a conservative judicial philosophy that appreciates the limited role of the court.  She is also deeply committed to her faith, her family and her community.  In the world of judicial appointments, Barbara Lagoa is a home run.  Governor DeSantis should be highly commended for a very thorough vetting process and a commitment to appoint such highly principled Justices as Barbara Lagoa.”</p>
<p style="text-align: center;">Judge Lagoa is the first of three appointments that Governor DeSantis will make to replace three of the court&#8217;s most liberal justices who termed out for mandatory retirement at age 70* yesterday on Tuesday, January 8, 2019. The retiring justices are Barbara Pariente (Lawton Chiles Appointment in 1997); Fred Lewis (Lawton Chiles Appointment in 1998); and Peggy Quince (Initially a Lawton Chiles appointee whom Jeb Bush also agreed to appoint on his first day of office in 1998).</p>
<p style="text-align: center;">During his inaugural address on Tuesday, Governor DeSantis forthrightly stated, &#8220;I say to you: judicial activism ends, right here and right now. I‘ll only appoint judges who understand the proper role of the courts is to apply the law and Constitution as written, not to legislate from the bench. The Constitution, not the judiciary, is supreme.&#8221;  Today&#8217;s appointment of Barbara Lagoa is evidence of this promise given Lagoa&#8217;s judicial philosophy.</p>
<p style="text-align: center;"><strong>Personal and Professional Bio on Judge Barbara Lagoa:</strong></p>
<p style="text-align: center;">Judge Lagoa’s parents fled Cuba and she was born in Miami, Florida.  She has served on the Third District Court of Appeals in Miami for the past twelve years since being appointed to that court by Governor Jeb Bush in 2006.  Of all 59 applicants that applied to the Supreme Court Judicial Nominating Commission, Lagoa had the most appellate experience. Over her 12 years on the appellate bench, Judge Lagoa has heard more than 11,000 cases and issued more than 470 written opinions. Judge Lagoa was also the first Cuban American woman to serve on the Third District Court of Appeals and is fluent in both Spanish and English.  She received her Juris Doctorate from Columbia University. Her civil practice focused on general and complex commercial litigation, particularly the areas of employment discrimination, business torts, securities litigation, construction litigation, and insurance coverage disputes. She also served as Assistant United States Attorney in the Southern District of Florida. In this office, she worked in the Civil, Major Crimes and Appellate Sections. As an Assistant United States Attorney, she tried numerous criminal jury trials, including drug conspiracies and Hobbs Act violations.</p>
<p style="text-align: center;">Judge Lagoa has been a member of the Federalist Society for several years.  She has also been actively involved with Kristi House, an organization that provides treatment, advocacy, and coordination of services for all child victims of abuse and their families, as well as education and prevention services to end child abuse and sex trafficking. She is married to attorney Paul C. Huck, Jr. and is the mother of three children.  The Lagoa family are faithful Catholics and attend the Church of the Epiphany in Miami.</p>

<p>In a storm-struck region of Florida that overwhelmingly favors conservatives, would-be voters tell relief workers they’re “just struggling to survive.”</p>
<p>Most polling places and indeed most structures are damaged or destroyed in the wake of Hurricane Michael. Shelters are packed, people don’t have roofs on their homes, and thousands have been displaced.</p>
<p>Florida Family Action, a social-conservative organization led by John Stemberger, has launched Operation Panhandle to provide voter assistance.</p>
<p>Stemberger’s team of 60 volunteers are navigating storm-tossed neighborhoods and shelters to help Hurricane Michael refugees get to the new, centralized polling locations there that have replaced the normal election infrastructure blown away by the storm, one of the strongest to ever hit the United States.</p>
<p>Over the weekend Stemberger filed this report from the front lines of the relief effort:</p>
<p>“I am writing this email in real time on the ground from the hurricane ravaged regions of North Florida where we are fully engaged in an emergency get out the vote (GOTV) campaign called “Operation Panhandle Vote.’</p>
<p>“We have set up our headquarters in Panama City, Bay County where the devastation was the worst and it is more serious than I could have ever imagined.</p>
<p>“As you read this, I am leading a group of about 65 of our volunteers and other modestly paid workers who have come from all across Florida to be part of this effort. We are walking through damaged neighborhoods, offering people voting information, poll location flyers, voter guides, snacks, water, a prayer and a ride to the polls.</p>
<p>“In some areas over 50 percent of the residential, commercial and government buildings have been completely destroyed. The power is just now being turned on for some households after weeks without it in the rural areas.</p>
<p>“The devastation is so bad, that two of our older volunteers told me yesterday that it was simply more than they expected or could handle and had to head back home. They were just exhausted and overwhelmed by it. It truly is a major disaster area.</p>
<p>“One pastor who is a very good friend of ours from one of the largest churches in the area said, ‘John, we can’t even take any more voter guides for other churches from you right now. We are feeding 8,000 people a day, most of our buildings have been damaged and we can barely keep up with just surviving…’</p>
<p>“Another pastor described people in his church spending most of their days just digging personal belongings from their wrecked homes and guarding their property from looters.</p>
<p>“After learning they did not have insurance for wind damage, many families have no way to think about rebuilding from the rubble of their properties.</p>
<p>“I have been in active communication with the Supervisors of Elections [SEO] in Bay and surrounding counties.</p>
<p>“Pursuant to the Governor’s Emergency Executive Order on Hurricane Michael, the SEO has designated voting/polling places available and open, six major Mega Polling sites. This morning we are also moving into and canvassing Calhoun, Gadsden, and Franklin counties.</p>
<p>“It is somewhat challenging approaching people in the midst of this kind of suffering and reminding them to vote but this area is critical to every statewide election in Florida and it has been hit hard.</p>
<p>“The people here were so glad to be reminded of the election as it has just been completely off the radar for thousands of voters here. These votes could make the difference in this very close election.”</p>
<p>“This project was certainly not in our annual operating budget, but the votes of these good people are just as important as yours or mine, so we are doing everything in our power to help them make their vote count!”</p>

The Florida Constitution has become a laughingstock and should be taken more seriously. Our state’s most important and fundamental legal document addresses everything from legitimate, fundamental human rights to the highly questionable regulation of pregnant pigs and fishing nets.</p>
<p>In short, the Florida Constitution is bloated. The average state constitution has approximately 26,000 words; Florida’s Constitution has more than 44,000 words. The U.S. Constitution has only 8,770 words.</p>
<p>It is clear that state constitutions have a broader purpose than the U.S. Constitution. This is true in part because the federal Constitution limits its own scope by the 10th Amendment that states &#8220;powers not delegated to the U.S. by the Constitution are reserved to the states.</p>
<p>However, just because state constitutions are broader in scope than the U.S. Constitution does not mean state constitutions should be unlimited in scope. Florida’s Constitution was not intended to be a collection of policy issues and regulatory rules; it has a much higher purpose.</p>
<p>Some states have &#8220;statute referendums,&#8221; where citizens by a direct statewide vote can place new laws into state statutes. A state statute referendum was one of the many ideas submitted by the public to the Constitutional Revision Commission, but no commissioners adopted it or put it forth.</p>
<p>As a member of the CRC, I argued that one of four objective criteria should be met for an idea to qualify as an appropriate topic for an amendment. If the idea satisfies at least one of these threshold criteria, only then should a policy analysis take place as to whether the idea is a good one. The threshold questions:</p>
<p>1. Does it set forth a fundamental right?</p>
<p>2. Does it establish the structure of government?</p>
<p>3. Does it limit the powers of government?</p>
<p>4. Does it amend a provision already set forth in the Constitution</p>
<p>Some began calling this the &#8220;Stemberger Test.&#8221; It is a test, but it is certainly not something I invented or that is unique to me. Former Florida Supreme Court Justices Major B. Harding and Kenneth Bell also have written on the same topics, arguing for very similar criteria for the CRC to consider. The principles behind these criteria simply stem from the nature of our form of government.</p>
<p>Conservatives almost exclusively refer to our form of government as a &#8220;republic.&#8221; Those left-leaning almost exclusively call our government a &#8220;democracy.&#8221; So, which is it?</p>
<p>The truth is, it’s both.</p>
<p>We are a representative democracy that operates within a constitutional republic form of government. We vote for and elect legislators who represent us by voting on bills which become law, on our behalf.</p>
<p>Our state Constitution is the document that gives Florida a republican form of government. Constitutions, by their very nature, restrict the power of the &#8220;state&#8221; to interfere with the rights of the people, thereby protecting them from government interference.</p>
<p>The primary difference between a republic and a democracy is that in a democracy the law rules the people, but in a republic the law rules the rulers. This is a critical distinction, and the Constitution is the supreme law of the land that &#8220;rules the rulers.&#8221;</p>
<p>The clearest example of this is illustrated in the opening words of the First Amendment to the U.S. Constitution. It famously announces, &#8220;Congress shall make no law …&#8221; In other words, government keep your hands off of the following rights and human liberties that belong to the people.</p>
<p>This notion of one greater law that rules the rulers is a revolutionary idea in the course of human history and one that must be vigorously protected.</p>
<p>Therefore, constitutions were never intended to be vehicles to hold ordinary public policy ideas.</p>
<p>In a sense, not all laws are created equal. Local zoning ordinances are different than state statutes, which are different than constitutional rights. You would not protect fundamental rights in a zoning code any more than you would regulate the size of roofing nails in the constitution.</p>
<p>But that’s precisely what has been done, to some extent, in Florida’s state Constitution. The document that was designed to be the supreme law of the land has in some areas been relegated to mere mob-rule depository for any policy or regulation usually found in ordinary law.</p>
<p>Florida voters are the ultimate guardians of our Florida Constitution. Whether we end up with document that’s a wily patchwork of random regulations, or one that enshrines the most fundamental rights in our state, rests in their hands.</p>

<p><strong>We must equip our young people to not only be ready and able to withstand the pressure and the attacks on their faith and values, but to thrive and be ready to change the world for Christ!  </strong></p>
<p>The way to do this is to find true champions of our values in young people, and train and equip them to be leaders, ready to be light in a dark and culturally hostile world.</p>
<p><strong>I cannot stress enough, how important investing in, and training, the next generation is!</strong></p>
<p><strong>This is why we are excited to bring the Patriot Academy training program to Florida.</strong></p>
<p><strong>Patriot Academy </strong>is a 3-day intensive training opportunity <u>for young people ages 16-25</u>.  Through training in communications, worldview, debate, leadership, politics, law, and history, students are trained and equipped <u>to confidently stand for and articulate their faith and values</u>. <strong> </strong></p>
<p>For three days young people will live and work in the Florida Capitol.  They will argue for their idea on how to make the world a better place.  They will sit where the actual legislators sit, debate and see their names on the board when they vote on issues.  They attend training classes and are personally coached and taught how to stand for truth.</p>

<p>2016 was our first year to offer the <strong>Patriot Academy</strong> in Tallahassee and 25 students participated.  Our goal this year is to double the number of students and be able to train at least 50 students in 2017.</p>
<p>The only thing holding us back are the finances, which limits the number of scholarships available.</p>
<p><strong>This training will serve young people on their college campus, in the marketplace, and as they discover their voice and role as an active citizen and eventually a leader in their community. Whether they pursue public office or not this training is invaluable to teaching confident and helping then find their purpose in the world. </strong></p>

<p><strong><em><u>Lake County</u></em></strong></p>
<p><strong>Mount Dora</strong> <em>Sunday, January 15<sup>th</sup> at 3 pm</em> –  Sanctity of Human Life Service at The Lighthouse on Lake Dora in Grantham Point Park (311 South Tremain Street, 32757).  Pastor Don Feezer from Grand Island Baptist Church will speak.  The service is a Memorial to the 62+ million babies that have been lost to abortion since 1973 and a Celebration of lives that have been saved through the great work of pregnancy centers in our nation. In the event of inclement weather this service will be held at New Hope Presbyterian Church (19535 Airport Rd, 32736).</p>
<p><strong><em><u>Miami-Dade County</u></em></strong></p>
<p><strong>Miami </strong><em>Saturday, January 14<sup>th</sup> at 10 am</em> – 8<sup>th</sup> Annual Miami Sanctity of Human Life Celebration and Prayer Encounter at Riverside Baptist Church (10775 SW 104<sup>th</sup> Street, 33176).  This will be a time to celebrate the Sanctity of Human Life and to pray specifically for the Pregnancy Care/Resource Centers and Clinics in Miami.
